Employees on duty are entitled to vote during work hours

Next Sunday (the 4th) is the first round of Brazil’s presidential election.

FittipaldiGômara takes this opportunity to remind companies that they must grant employees the time necessary to travel to and cast their votes, regardless of the workload.

To protect employees from harm, the law establishes clear rules and prohibitions for employers:

No pay deductions: Time spent voting counts as normal working hours and cannot result in payroll deductions;
No time off in lieu: The company is prohibited from requiring employees to make up time spent voting.

Failure to comply with these rules may result in the company being held liable by the Public Ministry of Labor (MPT).

Our Labor Law team is available to answer questions about how these rules apply in the day-to-day operations of companies.
