The decision does not waive the obligations under the regulation: companies remain required to identify and manage psychosocial risk factors within the Occupational Risk Management Program (GRO). What is suspended, for now, is the possibility of penalties based on criteria still considered imprecise by the judge presiding over the case.<\/p>\n
Given this scenario, it is recommended that companies:
\n▫️ Continue to implement initiatives focused on mental health in the workplace, regardless of the suspension of penalties;
\n▫️ Document the measures already adopted regarding psychosocial risks;
\n▫️ Monitor developments in the ongoing conciliation proceedings at the Supreme Federal Court\u2019s Center for Consensual Conflict Resolution (Nusol), which will discuss clearer parameters for the regulation;
\n▫️ Seek specialized legal guidance for preventive compliance, avoiding exposure once the sanctions become applicable again.<\/p>\n
